【摘要】
本文採法制作業與立法政策影響評估之研究方法，檢視台灣景觀法草案之景觀法立法政策及目的、景觀定義、各景觀計畫定義、定位及上下或橫向聯繫、人民財產權保障與補償機制、景觀師簽證內容、範圍及效力、民眾參與機制、行政管制手段等面向，進而析論其妥適性，並參考日本與德國對景觀之相關立法例，分別從學理及實務面，研議解決與落實景觀法草案立法遭遇問題之法制修正建議，並針對在此法令下景觀專業人員之權責與功能提出建議，俾利景觀法制之建置。
The purpose of this article is to examine the contents of the Taiwan Landscape Act Draft. The Act included aspects of legislation policies and purposes, landscape definitions, an individual definition of the landscape plan, positions and both longitudinal and crosswise connections, protections of civil property rights and compensation mechanisms, professional landscape certification issues relating to scope and efficiency, public participation mechanisms, and administrative control. Research methods for both legal system and legal policy assessment we're adopted based on their appropriateness of these aspects of Taiwan Landscape Act Draft. In addition, relevant legislation cases from landscape acts in Japan and Germany were referenced to evaluate theoretical and practical implications and create suggestions to revise and modify the Landscape Act Draft during the legislation process when encountering problems related to the legal system. Landscape professionals' rights, responsibilities, and their functions under the implementation of the Taiwan Landscape Act established in the legal system are provided.
